The present general terms and conditions of use are intended to provide legal guidance on how to make the website available and to define the access’ conditions and use of services by the user.

These Terms and Conditions are available on the website under the heading “Terms”.

By accessing or using the Livetrend Services, you acknowledge that you have read, understood and agreed to these Terms.

 

ARTICLE 2: DESCRIPTION OF THE SERVICES

Livetrend provides a data-driven fashion intelligence platform combining artificial intelligence, market data analysis, trend reports and proprietary methodologies to identify, analyse and monitor fashion trends, consumer signals, products, colours, materials, styles and market evolution.

The Livetrend Services include, depending on the subscription purchased:

  • TrendFeed reports;
  • TrendSearch AI assistant;
  • TrendVision AI-powered creative tools;
  • Retail and market analytics dashboards;

Livetrend Services are designed to assist fashion professionals in their creative, merchandising, buying, marketing and strategic decision-making processes.

 

ARTICLE 3: ACCESS TO THE PLATFORM

Access to Livetrend Services is granted exclusively to authorised users under a valid subscription agreement.

Users shall maintain confidentiality of their login credentials; ensure that their account is not shared with unauthorised persons; provide accurate registration information; comply with applicable laws and these Terms.

Livetrend may suspend or terminate access in case of: unauthorised use; security risks; violation of these Terms; fraudulent activity.

 

ARTICLE 4: PERMITTED USE

The Client may: access the platform through authorised users; consult dashboards and reports; use insights internally for its fashion business activities; download or export authorised materials where functionality permits.

The Client shall not: reproduce, distribute, resell or commercialise Livetrend data; share access credentials with third parties; extract databases or datasets; scrape, crawl or automatically collect information from the platform; use bots, spiders or automated tools; reverse engineer, decompile or attempt to discover source code, algorithms or models; use Livetrend data to train competing artificial intelligence models; create a competing database, product or service based on Livetrend data; remove copyright, trademark or proprietary notices.

 

ARTICLE 4A: ENTERPRISE AI LICENSE

4A.1 Standard Licence – AI restrictions

The Standard Licence does not authorise the Client to upload, ingest, import, index, store, process or otherwise use Livetrend Content in any third-party artificial intelligence, generative artificial intelligence, machine learning, enterprise AI, knowledge-management or similar system or service.

Without an Enterprise AI License, the Client shall not use Livetrend Content with third-party AI or enterprise AI tools, including ChatGPT Enterprise, Gemini Enterprise, Microsoft Copilot, Claude Enterprise, Notion AI or equivalent solutions, whether such tools are operated directly by the Client or through a third-party provider.

The Standard Licence also does not authorise the creation of internal AI knowledge bases, Retrieval-Augmented Generation (RAG) systems, AI-powered internal search indexes, or other AI systems incorporating or making use of Livetrend Content.

4A.2 Enterprise AI License – Optional Upgrade

The Enterprise AI License is an optional paid extension to the Standard Licence. It must be expressly subscribed to by the Client and is not included in the Standard Licence unless otherwise agreed in writing.

The Enterprise AI License authorises the Client, during the applicable subscription period and subject to these Terms, to use authorised Livetrend Content within the Client’s internal AI, enterprise search, knowledge-management and analytical environments for the Client’s internal business purposes.

The Enterprise AI License is priced at twenty-five percent (25%) of the annual value of the applicable Livetrend licence, unless otherwise agreed in the applicable order form or subscription agreement.

4A.3 Permitted Enterprise AI Uses

Subject to the Enterprise AI License, the Client may:

  • ingest authorised Livetrend Content into internal enterprise AI systems and knowledge-management environments;
  • create and maintain internal knowledge bases incorporating Livetrend Content;
  • create and operate Retrieval-Augmented Generation (RAG) solutions using Livetrend Content;
  • index Livetrend reports and other authorised Content for internal search and retrieval;
  • create internal dashboards, analytical tools and decision-support systems incorporating Livetrend Content;
  • use Livetrend Content with enterprise AI tools such as ChatGPT Enterprise, Gemini Enterprise, Microsoft Copilot, Claude Enterprise, Notion AI and equivalent solutions, provided that all applicable conditions of the Enterprise AI License are respected.
4A.4 Conditions of the Enterprise AI License

The Enterprise AI License is granted solely for the Client’s internal business purposes and is limited to authorised users and authorised internal systems of the Client’s organisation.

The Client shall ensure that the AI or enterprise AI service used in connection with Livetrend Content does not use Livetrend Content to train, fine-tune or otherwise improve publicly available or generally accessible artificial intelligence models, or models intended for use by third parties outside the Client’s authorised internal environment.

The Client shall not use Livetrend Content to create, maintain or populate any database, dataset, knowledge product or other repository intended for resale, licensing, external distribution or other commercial exploitation of Livetrend Content.

The Client shall not use Livetrend Content, whether directly or through an AI system, to develop, train, improve or operate a product or service that competes with Livetrend or that substantially reproduces the functionality of Livetrend’s proprietary services.

The Client shall implement reasonable technical and organisational measures to prevent unauthorised access to Livetrend Content incorporated into its internal AI or knowledge-management systems.

Where a third-party AI, cloud or knowledge-management provider processes Livetrend Content on behalf of the Client, the Client remains responsible for ensuring that the applicable service configuration and contractual terms comply with the restrictions of this Enterprise AI License.

4A.5 Intellectual Property

The Enterprise AI License does not transfer to the Client any ownership or intellectual property rights in Livetrend Content, reports, analyses, databases, methodologies, visual content, software, models or other proprietary materials. All such rights remain with Livetrend or its licensors.

The Client may create internal outputs, analyses and knowledge structures using Livetrend Content under the Enterprise AI License, provided that such use does not circumvent the restrictions set out in these Terms or result in the external distribution or commercialisation of Livetrend Content.

 

ARTICLE 5: TRENDVISION – AI-GENERATED CONTENTS

TrendVision uses generative AI to create and/or transform visual content. In accordance with applicable transparency requirements, including Article 50 of the EU AI Act, AI-generated or manipulated outputs may contain machine-readable markings, metadata or other technical indicators identifying their AI-generated origin. Such markings may be detectable through technical analysis or within the generated content.

The Client acknowledges that such technical marking does not necessarily satisfy all disclosure or labelling requirements applicable to the subsequent publication or communication of the content. Where required by applicable law, including under Article 50 of the EU AI Act or other applicable national regulations, the Client is responsible for applying appropriate and clearly visible disclosure or labelling indicating that the content has been generated or manipulated using AI.

The Client remains responsible for the review, use, publication and dissemination of TrendVision outputs and for ensuring compliance with applicable laws and regulations in the jurisdictions and contexts in which such content is used. Livetrend does not guarantee that the technical markings or other transparency mechanisms implemented in TrendVision will, in themselves, satisfy all legal disclosure requirements applicable to the Client.

 

ARTICLE 6: ACCEPTANCE OF TERMS OF USE

The access and the use of the website are subjected to the acceptance and the respect of the present general conditions of use.

The publisher reserves the right to modify, at any time and without notice, the website and the present terms and conditions, in particular to adapt to the evolutions of the website by the provision of new features or the deletion / modification of existing functionalities.

By accessing or using the Website, the user acknowledges having read, understood and accepted these Terms and Conditions. If the user does not accept these Terms and Conditions, they must not access or use the Website.

 

ARTICLE 7: WEBSITE MANAGEMENT

For the proper management and security of the Website, Livetrend reserves the right, at any time, to: suspend, interrupt or restrict access to all or part of the Website, including for maintenance, updates, security measures or technical reasons; restrict access to certain features or sections of the Website to authorised users only; remove any content or information that may interfere with the proper functioning of the Website, violate applicable laws and regulations, or infringe third-party rights; temporarily suspend the Website or any part thereof in order to perform updates, maintenance or improvements.

 

ARTICLE 8: HYPERTEXT LINKS

The website may contain hypertext links to other websites on which Livetrend does not exercise control. Despite the preliminary and regular checks carried out by the publisher, the latter declines all responsibility for the contents that can be found on these websites.

The inclusion of any link does not imply endorsement, partnership or affiliation between Livetrend and the relevant third party.

Livetrend may request the removal of any link to the Website that is misleading, unlawful or likely to harm its reputation or interests.

 

ARTICLE 9: LIMITATION OF LIABILITY

Livetrend provides data-driven insights, analyses, forecasts and recommendations intended to support users in their creative, commercial and strategic decision-making processes.

However, Livetrend shall not be responsible for how users interpret, evaluate or apply the information, insights or analyses provided through the Services.

Users remain solely responsible for their decisions, strategies, actions and business outcomes resulting from the use of the Livetrend Services. Livetrend shall not be liable for any decision made, or any action taken or not taken, by users based on the insights, analyses or information made available through the Services.

To the maximum extent permitted by applicable law, Livetrend shall not be liable for any indirect, incidental, special or consequential damages, including but not limited to loss of revenue, loss of profits, loss of business opportunities, loss of anticipated savings or commercial losses arising from the use of, or reliance on, the Livetrend Services.

 

ARTICLE 10: INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights relating to the Livetrend Services are owned by Livetrend or its licensors.

The trademarks, logos, signs and all the contents of the website (texts, images, sound…) are protected by the code of intellectual property and more particularly by the copyright.

Any reproduction, representation, modification, distribution or exploitation, whether partial or total, of the Livetrend website, platform, reports, analyses, databases, software, methodologies, visual content or any other proprietary materials, by any means whatsoever, without the prior written authorization of Livetrend, is prohibited and may constitute an infringement under the provisions of the French Intellectual Property Code (Code de la propriété intellectuelle), including Articles L.335-2 and following relating to copyright infringement.

In accordance with Article L.122-5 of the French Intellectual Property Code, users may only make limited use of protected content where such use falls within legally permitted exceptions, including the right of quotation, provided that the author and source are properly acknowledged.

The subscription grants the Client a limited, non-exclusive, non-transferable and non-sublicensable right to access and use the Livetrend Services solely for internal business purposes during the subscription period.

No ownership rights are transferred to the Client.

 

ARTICLE 11: PERSONAL DATA

Personal data processed by Livetrend is handled in accordance with applicable data protection regulations, including GDPR.

ARTICLE 13: APPLICABLE LAW AND JURISDICTION

These Terms of Use shall be governed by and construed in accordance with French law. In the event of any dispute arising out of or in connection with these Terms of Use, the parties shall first seek to resolve the matter amicably.

If no amicable resolution can be reached, the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Paris, France, unless otherwise required by applicable mandatory laws.
